You may not claim the original artwork or design as your own, and you may not set it up for commercial redistribution.

Feel free to change the design into other forms or closed species! Remember to credit me as one of the designers. Should you trade/sell the design, all other forms must go with the original design.

Redesigns are allowed as long as done by a human artist and NOT generative AI.

Any names and little descriptions I may give adoptables are optional, so feel free to give them new names/personalities/etc.!

Adopts are sold for personal use, but you may message me if you wish to use it for monetized/commercial reasons. Should you be using the adopt sold commercially when you do not have the right, I will contact you and discuss. Should I find our discussion unsatisfactory, I will blacklist you and state why.

I have the right to not sell an adopt to anyone for any reason.

My designs and artwork are not to be used for NFT/AI related purposes.

I am always open to edits if you wish to change parts of the design. Should it be a significant amount, I might add a fee.

I retain partial rights to the design. This includes all copyrights, rights to the intellectual property, the rights to distribute, reproduce, and use in my online galleries unless discussed otherwise. I will not reuse or resell the design again for personal and commercial projects, unless the design has been traded back to me or has been reclaimed due to TOS violation(s).

You can crop, rotate, or resize it for anything such as icons or pagedolls. However, please do not draw over the original artwork unless you have asked/informed me. I am always available for edits but in the case I am not, please tell me before you or another artist edit the image.

YOU MAY NOT USE GENERATIVE AI TO EDIT THE IMAGE

You may sell, trade, or gift designs purchased from me, unless a rule in its corresponding listing states otherwise.

Any design you received from a trade or gift cannot ever be resold for real money or equivalent (e.g. dA points or art trade) unless discussed prior with me.

Please don't sell a design by me for more than what was paid. Exceptions if they have extra art, bought using real money/your own personal art, the price of which can be tacked on.

If you do have an emergency, you may DM me and ask to sell it for more than it's worth in an auction style resell.

By commissioning me, you are agreeing with the terms listed below.

Certain terms can be changed or adjusted through a mutual agreement established prior to the commission.

Please read this entirely and carefully. I will refuse your commission if you do not agree to these terms.

If you are not comfortable with my Terms Of Service and/or are not willing to agree to the conditions, you may not request a commission.

You will agree here to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provide all image credits to me.

I do not allow my art to be used for AI purposes and alike. Please do not upload it to any AI sites as this could compromise my artwork. My works are not allowed to be used as NFTs, or used on the blockchain / blockchain technology, any / all of my works used on blockchain websites and services are infringements and will be reported. Likewise my works are not allowed to be changed or adjusted by machine learning or derived technologies, or for derivatives of my works to be created through the use of above-mentioned technologies.

There may be slight differences between the samples in my gallery and the illustration you will receive. I am still developing a style of art as I have only started drawing early 2022, so my style might change slightly

Any comments that are rude, inappropriate, inflammatory, and/or non-constructive may result in refunding your commission and/or blacklisting.

Violators will be added to my blacklist indefinitely and without warning.

By commissioning the Artist, you are purchasing my service as an artist only.

The Artwork is going to be drawn by churrosbosan ("Churros", "the Artist", "me"), to the best of the Artist's abilities.

The Client is going to receive a digital copy of the commissioned artwork unwatermarked, in full resolution.

No physical copies will be provided or shipped.

Artist reserves the right to post Client's finished artwork in Artist's gallery for any reason unless discussed prior.

Unless discussed otherwise, the Artist might share work in progress shots as well as stream the process of creating of the artwork publicly or using various ways of monetization (eg. Patreon) with the general public.

Artist reserves the right to decline any project or client for any reason. Any ill behavior¹ will not be tolerated and the commission will be canceled and refunded if it occurs.

Artist works Monday to Friday, and during the weekend Artist might not reply your contact message (DM, email, discord). Please, stay considerate of this, and if the Client's matter is pressing, make sure to state it in DM or title of the email so it's easier for Artist to see.

If Artist experience any issues (health wise and etc.), Artist will inform you, ask you to be considerate and let the Artist solve it before continuing commissions.

Client, will be expected to have read my TOS at least once. Client must be above the age of 18 years old and legally able to commit to an transaction once agreed upon.

Client, may display my work on external sites as long as it is visibly credited and linked back to me.

Client may not upload or host my work in any gallery that is intended to display your own work only.

Client may not claim my work as your own. Please only upload the copyrighted file publicly unless otherwise discussed.

Client may use the Artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays.

Client reserves the right to print or create a physical reproduction of the Artwork as long as it is for your PERSONAL use only (ie. NOT for sale). Client may not use the Artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc.) unless discussed beforehand.

Alongside the full resolution unwatermarked file, the Client will also receive a copy "for posting", which is going to be sized down, of lower dpi and watermarked. It is encouraged to use this version if posting the Artwork on SNS (Social Network Sites; "social media") to protect the integrity of the Artwork.

In the case of an adoptable, Client retains the rights to the character design, unless found to have violated any of my terms of service listed here.

After the files are delivered to the Commissioner, the Artist is not responsible for certain situations in which the files might get lost (like hardware damage/malfunction/loss, issues with online storage on side of the provider). To ensure their further availability, save the files on your own devices.

Clients are NOT authorized to change, modify, edit or use Artist's works or WIP images without Artist's permission. Clients are NOT authorized to trace over the Artist's artwork in any way, including the use of the artwork as a “base.”

Any ill behavior will not be tolerated and Client's commission will be canceled and refunded if it occurs.

Any changes to it are going to be discussed case to case in private messages and as such are also binding for both parties.

If Client wishes to have a personalized contract drafted instead of agreeing to Terms of Service, please reach out to me before proceeding with payment.

Should the client decide to change or adjust the commissioned works through the use of machine learning or derived technologies, or create derivatives of the commissioned works through the use of machine learning or derived technologies, I will revoke all your rights to the artwork/designs and publicize what you have done to avoid such a situation from happening to other artists

By placing an order, Client agrees to these terms and conditions. Please read these terms carefully.

I usually take up to 1-2 days to respond to your initial order inquiry.

Whenever I send you a Work in Progress (WIP), I need your explicit confirmation that everything is good to proceed. WIPs might be given as well if I wonder something about the commission.

If you fail to reply after a week, I will assume there are no issues and proceed to the next stage of the commission.

WIP shots are going to be sent to you in small resolution. You are allowed to post them on your social media, but you have to credit me as the artist.

You are not allowed to transform the WIP shots using AI.

I have the right to decline a project if there is too short of a time allowance.

Turnaround rate is 1-2 months Please be aware that I have several medical issues that might cause delay. Any delay will be communicated to client.

If you did not alert me to a deadline, you must not send reminders until a 2 week's buffer period has passed. Reminders will be ignored if they relate to work that I have to prioritize above your project due to timelines.

If due dates are discussed, I will ensure to update as frequent as I can and clients are expected to reply promptly to any inquires from me to ensure the work is completed on time. I will not be held responsible for late delivery if the fault lies with the client

No harassment over my work speed will be tolerated unless the deadline of a commission has passed

I will work on art in a sporadic manner. This means I will work on the piece I'm the most inspired/ comfortable with at the moment.

You reserve the right to be notified of any delays.

If you need the deadline set earlier than the usual, then depending on the date and my current workload it might come with rush fee as described in Extra Fees section.

I reserve the right to sign and/or watermark my own work. I will send you a full resolution image (by discord message, email or via google docs), but my signature will remain on the Artwork.

You are responsible for protecting your ownership over rights to a character design made by me by creating a copy image with your name added as well (ie. through a watermark) when uploading on external sites.

I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a Public Commission, I may do whatever I wish with the art (eg. post it to other sites such as Instagram) but will give proper credit to you for ownership of the character’s design.

In the case of a commission, I will not claim the rights to a character design unless it was one of my own designs. Therefore I will not reuse/resell the Artwork for personal or commercial projects unless agreed upon.

In the case of an adoptable design, I will not reuse/resell the rights to the design once ownership is transferred to you, the Client.

I work on multiple commissions at the same time.

When my commission slots are full, you can request to be added to the wait list.

Being added to the wait list is free of any charges and you are allowed to retract your request at any time

Waiting time after being added to [the wait list] to placing the order depends on many factors such as; Health, work or family issues, amount of orders I'm able to complete each month.

There is no obligation to proceed with the order once I reach out to you in order to confirm your interest.

To join the wait list, just contact me via email or direct message on any of my social media accounts. Discord or email will get the fastest reply from me.

If you want to skip the wait list, I'll attach a rush fee, but no exact deadline will be set unless you give me one.

Because my prices can change, if you are on the wait list while they change, once your slot is moved to my current queue, please be aware that you will be paying the most updated price.

I am not responsible for any mistakes that are made on your part over the course of the transaction.

Payment is required upfront unless we agreed otherwise.

Payment plan is possible to set for all orders, but until the full payment is not completed, you will not receive the full resolution files nor the rights to use it in any way.

Depending on the complexity of design or commission type + any add-ons requested, prices can increase. The prices listed are my base prices. You are allowed to ask me an estimate for an idea you have in mind and come back later if the price is out of your current budget.

After 100% of the payment is sent, I will start working unless discussed prior.

I will initiate the transaction to avoid accidental transactions. Do not send me any kind of payment until I have confirmed I can accept your commission AND have asked for payment.

Paying in any other way (not agreed upon, not discussed) is considered a donation.

Repeated counts of commissioning a project and failing to pay will result in blacklisting.

For auctions, you are NOT allowed to retract your bid unless you have informed me beforehand why. On your first problematic transaction, you'll receive a simple verbal warning. The next time you back down from the auction ,you will be blacklisted and refused the opportunity to bid in the future. Only bid if you are sure you can pay your bidding.

There is no fee charge for changes during the sketching phase.

During the lineart/colouring phase, each major revision is charged at least 15% of the total price of your commission (so please, be clear in your request if you have prepared a specific pose/idea).

Every time when I send you a WIP, you're allowed (and encouraged) to let me know if you would like me to make any changes to the artwork.

Please note, that these changes have to be relevant to the stage of the WIP. (In other words: you can only change pose of the character during sketch/concept phase. You can only request change to coloring choice during flat colors phase, etc.).

After a commission is finished, only small changes are allowed to be made, such as small coloring/marking mistakes and details forgotten on my side. They are only possible to be made within a month from completion of the artwork.

Any great changes will come with an extra charge: such as an outfit change, outfit addition or subtraction, background change or anything that makes me have to redraw completely any parts of the artwork

You are not allowed to use rejected sketches and I am allowed to use them for future artwork, YCH, base sets.

Adding different file types (.psd, video of speedpaint) might come with extra fee depending on the project type.

Cutting the illustration for animation comes with a fee depending on complexity of your project. Please, note, I do not make the animation, just the cutting

If you attach a deadline (within one month) in your order form, a rush fee will be added automatically.

The quicker you want it, the higher the fee (Minimum + 50% of the base price of your commission OR + $10 for commissions $30 and under)

You are NOT authorized to issue a chargeback for unjust reasons.

You are required to contact me when you need to cancel a commission request.

Purposefully issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting for you as well as your email address. Your license to every artwork I have ever made for you (adoptables, character designs, any obtained licenses to use of my artwork) will be retracted (non-refundable) and I have the right to sell the copyrighted artwork (as YCH) or design to new buyers.

Your username will be publicly posted on a blacklist for others to watch out for.

You will be forbidden from ever commissioning me again.

By commissioning me, you forfeit your right to receive a refund depending on the level of completion.

Once the work on a commission is started, you are not going to receive full refund unless below situations apply:

At minimum, you will not receive 10% of the refund.

After receiving a refund, you will NOT receive the file of the artwork I have been working on so far, and are NOT allowed to use any of previous WIPs.

Unless agreed otherwise, I retain original copyright and ownership of the artwork, which includes but may not be limited to redistributing, reproducing, advertising, displaying the artwork in my websites, social media and portfolios according to my discretion.

Your rights to redistributing, reproducing, advertising, displaying the artwork in your websites, social media are rooted in the form of license of your choice, as explained in this section of Terms of Service.

Any other than personal use price may be discussed and adjusted depending on factors such as your audience size.
